Standard Terms & Conditions of Sale
These terms and conditions govern the sale of all products and services by SKY SHOT DESIGN and apply notwithstanding any conflicting, contrary or additional terms and conditions in any purchase order or other document or communication from the buyer.
These terms and conditions may only be waived or modified in a written agreement signed by an authorised representative of SKY SHOT DESIGN.
The contract for the sale of the goods by us to you and will only be formed in accordance with these conditions. These conditions apply to the sale by us to you of all products purchased through the SKY SHOT DESIGN website, by telephone, written communication or through orders taken at events.
Privacy Policy
SKY SHOT DESIGN will maintain the privacy of your personal information when using our web site or in any other dealings with the company. SKY SHOT DESIGN will collect the necessary information that will enable us to provide you with our products and to communicate other information that SKY SHOT DESIGN believes would be of interest. In order to continually evolve and improve our products, website and company communications SKY SHOT DESIGN will routinely review our website usage and this includes collecting IP addresses of our website visitors. This is in line with standard practice. We may use this information to provide advertisers and other third parties with information about our user data base and usage patterns. We will never however exchange to third parties any personal or confidential information unless you have specifically consented for us to do so or if this is required by law or other statutory requirements. With your consent, we will use network advertisers to provide information and advertisements on behalf of SKY SHOT DESIGN. You will however be given the option to refuse third party contacts. Please note that if you enter other websites from the SKY SHOT DESIGN website the privacy policy may differ from that described above and you are advised to read the privacy policy of each individual company’s website.
Security
All monetary transactions with SKY SHOT DESIGN are secure. We use certified and authorised encryption devices to protect your banking or credit card details. SKY SHOT DESIGN payment pages are held on PayPal secure servers and we do not deal with, or retain your credit card information. PayPal carry out the necessary card verification processes and we will check your contact details. If we are unable to supply any goods for any reason we will inform you as soon as possible and we will provide you with a refund for these goods within 14 days. Price & Payment
Payments must be made when you place an order. The price to be paid by you is the price displayed on the website (excluding delivery charges, and if applicable import tax and duties) when your order is received by us except in cases of obvious error. If we discover an error in the price of the goods ordered by you we will notify you as soon as possible providing you with the option of either reconfirming the order at the correct price or cancelling the order. If we are unable to contact you for the purposes of this condition the order will be deemed cancelled and where you have already made payment for the goods this will be refunded in full. We accept payment through PayPal online. You will receive confirmation of card payment and your unique order number via email. If your card is not authorised, you may be given the opportunity to try again or use a different card. No payment will be deemed to have been received until we have received cleared funds. The prices for the goods are in pounds sterling (GBP) and inclusive of any value added tax at the rate of 20% but do not include delivery charges and if applicable import tax and duties (see also section G)
Products
Stock Availability
Whilst every effort is taken to ensure all items are in supply, occasionally some items may be temporarily out of stock. Orders can only be accepted subject to availability of the goods in question. All promotional offers are subject to stock availability. In the unlikely event of an item being unavailable at the time of dispatch we will advise you immediately by notice in writing (including by email), offer you alternative goods or colour or refund accordingly.
Colours & Sizes
Whilst every reasonable care has been taken in producing the SKY SHOT DESIGN products, we cannot guarantee that the colour reproduction is an exact match with the goods sent to you. Whilst we endeavour to be as accurate as possible, all sizes quoted are approximate.
Packaging
We will use reasonable endeavours to ensure the goods are appropriately packaged prior to dispatch.
Dispatch
Following your Pay Pal payment you will receive a sales invoice email within two working days. This will provide your unique order number, purchase details, the total order price and delivery details including transport costs. Please be aware that orders can take up to 2 weeks to be dispatched. Any special orders or custom paint services can take longer. Delivery
Unless otherwise agreed, SKY SHOT DESIGN will deliver the goods to the cardholder’s address provided to us by you at the time of order. If it is more convenient for you to have goods delivered to a workplace or any other suitable location, please give us this information when you will complete order delivery details. The price for goods to be delivered to a destination in the British Isles or internationally excludes delivery charge and any import taxes, customs charges or other duties.
UK Delivery
Charges: The online price quoted includes VAT at 20% but excludes delivery charges. These will be added to your invoice at your time of payment. Delivery date: Subject to condition G3 we will use reasonable endeavours to deliver the goods within 6 weeks of your payment. If for any reason you fail to accept delivery of any of the goods when they are ready for delivery, or we are unable to deliver the goods on time because you have not provided appropriate instructions, documents, licences or authorisations we will arrange storage of the goods until delivery, whereupon you shall be liable for all related costs and expenses (including, without limitation, storage and insurance). It is your responsibility to check the goods for any damage and that they are what you ordered upon receipt and you must inform us in writing of such damage within 14 days of delivery. If you fail to inform us of any such damage you are deemed to have accepted the goods. SKY SHOT DESIGN accepts no liability (including without prejudice to the generality of the foregoing in negligence) for loss or damage to goods in transit.
International Delivery
Charges: The online price quoted includes VAT at 20% but excludes delivery charges. These will be added to your invoice at your time of payment. All orders for international delivery exclude import duty, customs charges or other duties. Please note that we do not have control over these charges and cannot predict their amount. Please contact your local customs office for further information before placing your order. If the goods sent from SKY SHOT DESIGN are impounded by customs, delivery charges and cost of goods will not be refunded. Please also note that you must comply with all applicable laws and regulations of the country for which the goods are destined. We will not be liable for any breach by you of any such laws. If the goods are returned you will be charged for all shipping charges and if SKYSHOT DESIGN is deemed to be at fault we will reimburse you the delivery charge. Delivery date: Subject to condition G3 we will use reasonable endeavours to deliver the goods within 6 weeks of your payment. Force Majeure
If SKY SHOT DESIGN is delayed or prevented from performing the contract or any part thereof by circumstances beyond its reasonable control including (but without limiting the generality of the foregoing) strikes, lockouts or other industrial action, inability to obtain materials or labour, power or machinery breakdown or failure, fire flood, civil commotion or any cause of whatever kind and wherever occurring, then SKY SHOT DESIGN may suspend further performance of the contract for so long as it is so delayed or prevented and such suspension shall not constitute a breach of the contract. SKY SHOT DESIGN shall notify you of any such suspension of performance of the contract and if such suspension continues for more than 12 weeks either SKY SHOT DESIGN or you may by notice in writing to the other, terminate the contract but without prejudice to the SKY SHOT DESIGN’S right to be reimbursed all costs charges and expenses incurred by us pursuant to the contract up to the date of such notice of termination and up to the date of receipt thereof by SKY SHOT DESIGN.
Returns & Refund Policy
SKY SHOT DESIGN is confident that you will be pleased with your purchases. However, there may be occasions when you will need to return items to us. In the event that you return goods to us because you have cancelled the contract within the cooling-off period (see section K), we will process the refund due to you as soon as possible and, in any case, within 14 days of the day you gave notice of cancellation. In such circumstances we will refund the price of the goods in full. See below for how to return the goods. For any other reason; for example, because you claim that the goods are defective or do not conform to their description, we will examine the returned goods and will notify you of the results of such examination within a reasonable period of time. In the event that the goods are found to have been defective then we will offer to repair or replace the goods, or reduce or refund the price the goods (at your option). We will usually process any refund due to you as soon as possible and, in any case, within 30 days of the confirmation to you that you are entitled to a refund for the defective goods. Goods returned by you because of a defect will be refunded in full, including a refund of the delivery charges for sending the item to you and the delivery charge cost incurred by you in returning the item to us. NOTE: FOR ALL RETURNS AND REFUNDS OUR RETURN AUTHORISATION REQUEST FORM MUST FIRST BE SUBMITTED AND APPROVED – RETURNED GOODS CANNOT NOT BE ACCEPTED WITHOUT PRIOR APPROVAL. The Return Authorisation Request Form is available from our website at www.skyshotdesign.com. This should be emailed or faxed to SKY SHOT DESIGN using the contact details found at www.skyshotdesign.com/contact. This must be printed off and completed by you.
How to return goods
SKY SHOT DESIGN will email you on receipt of the Return Authorisation Request Form. Once authorisation has been approved details of our returns address will be emailed. The goods must be returned to us at your own risk, in their original packaging with all tags and labels and where appropriate software attached. Goods may be tried on for fit but must be otherwise unworn and returned unsoiled. In all cases, you are responsible for ensuring that the goods arrive at our dispatch location safely. We do not accept responsibility for goods that fail to arrive in their original condition. For this reason we encourage you to insure the goods against loss or damage while in transit. You must also pay for the cost of returning the goods unless we deem them to be faulty or not as described, in which case we will credit you for the cost of returning the goods. You are advised to obtain a proof of posting certificate for your returned goods. SKY SHOT DESIGN cannot be held responsible for loss of returned goods without proof of posting.
Authority to credit / charge your account
By submitting the Return Authorisation Request Form you authorise us to credit or charge your account in accordance with the above terms and conditions using the details provided by you in effecting the original transaction
Risk & Ownership
The goods will be at your risk from the time of delivery (or deemed delivery) or, if not delivered, on collection from SKY SHOT DESIGN. Ownership of the goods will pass to you when SKY SHOT DESIGN has received payment for the goods from you in full and the goods have been delivered to you.
Consumer Rights
You are legally entitled to cancel the contract at any time within seven working days of order (the “cooling-off period”). In the event that the contract is cancelled in this way within the cooling-off period you will receive a full refund. In order to exercise your right of cancellation you must provide us with written notice by email of your cancellation within the cooling-off period. You shall not have any right to cancel a contract for the supply of any goods which are personalised or made for your specification in any way. You will be entitled to reject any goods within 14 days of their delivery if it becomes apparent during this time that the goods did not conform with their description in the contract when they were delivered to you. In order to return goods you must first submit a Return Authorisation Request Form. Unless we are able to demonstrate that the goods did conform to their description at the time of delivery, we will offer to repair or replace the goods, or reduce or refund the price of the goods. See section H1 for details of how to return goods to SKY SHOT DESIGN.
Liability
If the goods we deliver are damaged or defective or the delivery is of an incorrect quantity, we shall have no liability to you unless you notify us in writing of the problem within 14 days of the delivery of the goods in question. Nothing in these conditions however is intended to limit any rights you might have as a consumer under applicable local law or other statutory rights.
Limitation of Liability
SKY SHOT DESIGN shall not be liable to you for any loss or damage whatsoever or howsoever caused (including without prejudice to the generality of the foregoing in negligence) arising directly or indirectly in connection with the contract, except to the extent to which it is unlawful to exclude such liability under the applicable law, including (without prejudice to the generality of the foregoing) liability for any indirect, special, incidental or consequential loss or damage which may arise in respect of the goods, or in respect of equipment or property or otherwise in connection with the agreement, or for loss of profit, business revenue, goodwill or anticipated savings.
Warning
You purchase and use SKY SHOT DESIGN products entirely at your own risk with full knowledge that Skydiving is an extreme sport and as such is dangerous. You are advised to ensure you are appropriately trained and equipped to carry out skydiving activities. . SKY SHOT DESIGN has developed its products from a user-centred design perspective using the latest anthropometric and safety information. SKY SHOT DESIGN helmets are specifically designed for skydiving activities; you are advised not to use these helmets for any other activity. SKY SHOT DESIGN helmets do not offer protection against injury or death.
Complaints Policy
SKY SHOT DESIGN is committed to providing a quality service to you and values your views, opinions and feedback on any goods which have been supplied to you, or the service which we have provided to you. If we have not performed any of our duties to a satisfactory standard please contact us and we shall endeavour to put right any problems. If the complaint relates to the quality or specification of goods please refer to our refund policy (see section H). For any other complaints, queries or to provide us with feedback, please contact us at info@skyshotdesign.co.uk. We shall endeavour to contact you within seven working days of receiving your email and shall work closely with you in trying to resolve any problems fairly and quickly and to ensure that both our goods and the services which we have provided to you are to your satisfaction.
Written Communications
Applicable laws require that some of the information or communications we send to you should be in writing. When using the website, you accept that communication with us will be mainly electronic. We will contact you by e-mail or provide you with information by posting notices on the website. For contractual purposes, you agree to this electronic means of communication and acknowledge that all contracts, notices, information and other communications that you provide to us electronically comply with any legal requirement that such communications be in writing. The provisions set out in this condition do not affect your statutory rights.
Our right to vary these terms & conditions
SKY SHOT DESIGN has the right to revise and amend these terms and conditions from time to time to reflect changes in market conditions affecting our business, changes in technology, changes in payment methods, changes in relevant laws and regulatory requirements and changes in our system’s capabilities. You will be subject to the policies and terms and conditions in force at the time that you order goods from us, unless any change to those polices or these terms and conditions is required to be made by law or governmental authority (in which case it will apply to orders previously placed by you), or if we notify you of the change to those policies or these terms and conditions before we send you the dispatch confirmation, in which case we have the right to assume that you have accepted the change to the terms and conditions, unless you notify us to the contrary within seven working days of receipt by you of the goods.
